Family You may attain a Green Card for a family member by petitioning as a sponsor for them.  Family petition for Green Card / Permanent Residence are granted to immediate family members of current US Citizens and Lawful Perment Residence.

If the family member is outside the United States, a petition for a visa to enter the United States is required first.  This can be done by filling out an I-130 for Petition of Sponsorship.  Once the I-130 is successfully received and processed, the Beneficiary (person trying to come to US) will be interviewed at a US Consular Post in their native country.  There they should receive a visa to enter the US and once in the US, then the Petitioner may submit an application for Lawful Permanent Residnce.

Depending on the relationship to the person sponsoring and the status of the sponsorer in the US, Green Cards and Permanent Residence is granted in order of priorities.  Factors that are included is the native country of the beneficiary of the petition.  The Priority Dates will affect when the visa to enter the US will be available.

You may see the priority dates on the US Department of State website. http://travel.state.gov/visa/frvi/bulletin/bulletin_3897.html

If your family member is already inside the US on a valid and current visa, then they will need to adjust their status.  You may see more information on the adjustment of status section.

Whether you seek to petition for a family member that is outside the US or already in the US, USAresidency.net may assist you in this process.  Please contact or office for a detailed examination of you specific situation.
